Tripartite Agreement signed for Backfilling Site of DPWH Flood Mitigation Project

Department of Public Works and Highways (DPWH) has signed a tripartite memorandum of agreement with the Laguna Lake Development Authority (LLDA) and Toyo Construction Company, Ltd. for the establishment of an ideal backfilling site for materials taken from the dredging and excavations of the banks and waterway of Lower Marikina River under the DPWH Pasig Marikina River Channel Improvement Project-Phase III.

The agreement was signed on December 17, 2018 by DPWH Undersecretary for Unified Project Management Office (UPMO) Operations and Technical Services Emil K. Sadain, LLDA General Manager Jaime C. Medina, and Toyo Construction Co. Ltd. Project Manager Kazushige Kishimoto.

With an effectivity period of two (2) years from December 2018 to December 2020, the agreement signing was also witnessed by DPWH UPMO Flood Control Management Cluster Project Director Patrick Gatan, Assistant Director Ramon A. Arriola III, and Project Manager Resito David; Engr. Ronaldo San Juan of the Local Government of Taytay, Rizal; and Engr. Lawrence Pineda of National Housing Authority.

Under the terms of this agreement, the LLDA which has regulatory functions and jurisdiction to the entire Laguna de Bay has offered the use of twelve (12) hectares property in Barangay Lupang Arenda, Taytay, Rizal as backfilling area for materials taken by DPWH contractor Toyo Construction from the dredging and excavations for the removal of accumulated massive silt and debris at downstream portion of the Rosario Weir at the Lower Marikina River area.

Prior to hauling and disposal of dredged materials, DPWH and Toyo Construction need to submit the requirements for the issuance of necessary permits and clearances from LLDA and other appropriate government agencies.

The backfill average height to be undertaken by Toyo Construction shall be up to 2.5 meters with the DPWH to perform strict environmental monitoring during the implementation of backfilling works in compliance with the condition of the approved Environmental Compliance Certificate.
