PROCUREMENT OF CIVIL WORKS CONTRACTS
A. Locally Funded Projects
The procurement of contracts for locally funded projects by the Department of Public Works and Highways (DPWH) is governed by Republic Act No. 9184, also known as the Government Procurement Reform Act, and its Implementing Rules and Regulations – Part A (IRR-A).
In accordance with the relevant provisions, the DPWH has established a Registry of Civil Works Contractors, managed by the Central Bids and Awards Committee-Technical Working Group (BAC-TWG), which is a database of the contractors’ legal, financial and technical information. Evaluation of the contractors’ eligibility is done electronically using the information stored in the Registry. Although, District Engineering Offices (DEOs) have the option to do manual eligibility evaluation, they still rely on the Contractors Registration Information issued by the Central BAC-TWG. All bonafide contractors who wish to do business with the Department must be accredited in the said Registry.
To apply for eligibility and to bid for a specific project of the Department, contractors need only to submit to the Implementing Office (IO) a duly accomplished expression of interest (form NR-003). Duly eligible contractors will be issued bid documents. Ineligible contractors have seven (7) calendar days to request for reconsideration.
B. Foreign-Assisted Projects
The procurement of foreign-assisted projects is based on the guidelines issued by the concerned lending institution, such as World Bank (WB), Japan Bank for International Cooperation (JBIC), Asian Development Bank (ADB), etc. The selection of contractors is based on the pre-qualification criteria concurred by these institutions and varies depending on the nature and complexity of the proposed contract to be bid.
